Terms of Service

By accessing or using TheHoopGang Creator Portal ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and TheHoopGang.

To use the Platform and participate in our Creator Program, you must:

• Be at least 18 years of age
• Have an active TikTok and/or Instagram account in good standing
• Provide accurate and complete information during registration
• Have the legal capacity to enter into a binding agreement
• Reside in a location where we can ship products

TheHoopGang Creator Program allows selected creators to:

• Receive free products (cropped sweatpants and other gear) in exchange for content creation
• Submit content (TikTok videos) showcasing our products
• Earn rewards through volume-based competitions and milestone achievements
• Participate in leaderboard competitions for additional prizes

Acceptance into the program is at our sole discretion. We reserve the right to approve, deny, or revoke creator status at any time.

When creating content for TheHoopGang, you agree to:

• Create original content that features our products authentically
• Post content to your TikTok and/or Instagram accounts
• Not engage in fake engagement, purchased followers, or artificial view manipulation
• Not create content that is offensive, discriminatory, illegal, or harmful
• Clearly disclose any sponsored or gifted content as required by FTC guidelines
• Not use our products or brand in any way that damages our reputation

By submitting content through the Platform, you grant TheHoopGang a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute your content for marketing, advertising, and promotional purposes. This includes the right to use your content in paid advertisements on social media platforms. You retain ownership of your original content.

Regarding products provided through the Creator Program:

• Products are provided free of charge in exchange for content creation
• You are responsible for providing accurate shipping information
• Shipping times may vary; we are not responsible for carrier delays
• Products remain our property until content obligations are fulfilled
• Resale of gifted products is prohibited
• Product availability and styles are subject to change

Regarding rewards earned through the Platform:

• Rewards are earned through milestone achievements and competition placements
• Cash rewards are paid via Venmo, PayPal, or CashApp
• Store credit can be redeemed at thehoopgang.com
• You are responsible for any taxes on rewards received
• Rewards are non-transferable and have no cash value unless specified
• We reserve the right to modify reward structures with notice

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity or fake engagement
• Fail to create content after receiving products ("ghosting")
• Create content that harms our brand reputation
• Provide false information during registration

Upon termination, you may be required to return any unreturned products and forfeit pending rewards.

TheHoopGang name, logo, product designs, and Platform content are protected by intellectual property laws. You may not use our trademarks, logos, or brand assets without written permission, except as necessary for creating approved content.

To the maximum extent permitted by law, TheHoopGang shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including lost profits, data loss, or business interruption. Our total liability shall not exceed the value of products provided to you in the preceding 12 months.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy or completeness of any information on the Platform.

You agree to indemnify and hold harmless TheHoopGang, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
